New Power of Attorney Rules Coming June 13, 2021
On June 13, 2021, the law in New York pertaining to powers of attorney will be changing. It is widely felt that the current requirements are cumbersome and unreasonable, making the document “prone to improper execution.” The law revisions are intended to make the document easier to understand, sign, and use.
A Power of Attorney is a document used so that one person, the principal, can authorize a second person, an agent, to conduct business on behalf of the principal. This can involve banking, life insurance, government benefits, pensions, real estate, and many other kinds of transactions. Powers of Attorney are useful in many situations, such as where elderly people become disabled or afflicted with dementia. The agent can pay bills or deposit checks on behalf of the principal. In Medicaid planning, Powers of Attorney can be used to transfer property out of the name of the principal so that the principal can qualify for Medicaid benefits.
